These Terms and Conditions ("Terms") govern your access to and use of the nimbeau website (the "Site") and any purchases you make from us. The Site is operated by Digital Marketplace Limited (NZBN: 9429052398209, GST: 144-057-244), a company registered in New Zealand ("we," "us," or "our").
By accessing the Site, browsing our products, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site or make any purchases.
We may update these Terms from time to time. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms.
1. Products and Orders
We offer filtered shower heads and replacement filters designed to improve water quality for healthier skin and hair. Product descriptions are provided for informational purposes and are accurate to the best of our knowledge. However, we do not guarantee that all details are error-free.
When you place an order, it constitutes an offer to purchase. We reserve the right to accept or reject any order at our discretion, including for reasons such as product availability, pricing errors, or suspected fraud. If we accept your order, we will send a confirmation email. Title and risk of loss pass to you upon delivery.
You must provide accurate and complete information when placing an order. We are not responsible for any issues arising from incorrect details you provide.
2. Pricing and Payment
Prices are displayed in the currency applicable to your location: New Zealand Dollars (NZD) for New Zealand customers and Australian Dollars (AUD) for Australian customers, unless otherwise stated. Prices include New Zealand Goods and Services Tax (GST) where applicable for New Zealand customers. For Australian customers, prices do not include Australian GST, duties, or taxes, which you may be responsible for upon import.
Prices are subject to change without notice. We accept payments via the methods listed on the Site at checkout. Payment must be made in full at the time of purchase. We use secure third-party payment processors and do not store your payment details.
If there is a pricing error on the Site, we may cancel the order and refund any payment made, or offer you the option to purchase at the correct price.
3. Shipping and Delivery
Shipping and delivery are governed by our Shipping Policy, which is incorporated into these Terms. Please review it carefully for details on processing times, delivery estimates, costs, and responsibilities.
We ship from our warehouse in Auckland, New Zealand. Delivery times are estimates only and may be affected by factors beyond our control, such as customs delays for international orders or peak periods. You are responsible for any customs duties, taxes, or fees for orders outside New Zealand.
If your order is lost or damaged, contact us within 7 days of the expected delivery date.
4. Returns and Refunds
Returns and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms. Please review it carefully for eligibility, process, and costs.
We offer 100-day returns for full product cost refunds on eligible items. You are responsible for return shipping costs unless the item is faulty. Refunds exclude original shipping fees.
For faulty or defective items, your rights under the New Zealand Consumer Guarantees Act or Australian Consumer Law (as applicable) apply.
5. Intellectual Property
All content on the Site, including text, images, logos, and designs, is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.
The "nimbeau" trademark is owned by us and may not be used without permission.
6. Warranties and Limitations
We do not offer any voluntary warranties beyond those required by law. Your statutory rights under the New Zealand Consumer Guarantees Act or Australian Consumer Law (as applicable) apply to our products, including guarantees that they are of acceptable quality, fit for purpose, and free from defects.
To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including for merchantability or fitness for a particular purpose. We do not guarantee that products will achieve specific results or suit every individual's needs.
Our liability for any claim arising from these Terms or your purchase is limited to the price you paid for the product, or replacement/refund at our discretion. We are not liable for indirect, consequential, or incidental damages, including loss of data, profits, or personal injury, even if advised of the possibility.
Nothing in these Terms excludes or limits your statutory rights under applicable consumer laws.
7. Privacy
We collect and use your personal information in accordance with our Privacy Policy, which is available on the Site. By using the Site, you consent to our collection and use of your data as described.
8. User Conduct
You agree not to use the Site for any unlawful purpose, to interfere with its operation, or to submit false information. We may terminate your access at any time for violations.
